 Join Ted Smith and Susan Burton with Cornell Smith Mierl Brutocao Burton LLP to learn more about recent developments, rules, and regulations affecting employers in the legal industry and steps to take to stay compliant.

 Ted Smith will provide details regarding recent Federal Trade Commission (FTC) and the U.S. Department of Labor (DOL) rulings, how to stay ahead in this rapidly evolving legal landscape, show how these "bombshell" rulings on non-compete agreements and overtime rules could affect business practices, and what steps you should take to avoid litigation.

 Susan Burton will explain two recent Equal Employment Opportunity Commission (EEOC) releases that impose more regulations on employers, workplace harassment, and regulations to protect pregnant workers under the Pregnant Workers Fairness Act (PWFA).

 Objectives:

  1. Enhance knowledge of non-compete agreements and the changes that impact future employer-employee relationships.
  2. Obtain information regarding the new overtime exempt rules, including the new minimum salary thresholds.
  3. Develop ways to prevent workplace harassment, including virtual work environments.
  4. Be prepared for new regulations by knowing who is covered, the reasonable accommodations, and what employer defenses are available.

About our presenters:

Ted Smith is Board Certified in Labor and & Employment Law by the Texas Board of Legal Specialization. He has been listed as one of The Best Lawyers in America in the specialty of Labor and Employment Law since 2010, and was recently honored by that publication as the Austin “Lawyer of the Year” in the area of Employment Law - Management.  In addition, Mr. Smith has been named as a “Texas Super Lawyer” in the field of Labor Law by Texas Monthly magazine since 2003, and selected to the list of "Top Attorneys in Texas.”

 Mr. Smith specializes in representing employers in all aspects of the employer-employee relationship, from litigation and appeal to training and advice.  In particular, Mr. Smith has significant experience litigating and counseling clients regarding federal and state employment statutes (including Title VII, the TCHRA, the FLSA, the ADEA, the ADA, the FMLA, and the NLRA), as well as wrongful discharge claims, non-competition and theft of trade secret matters, individual employee rights issues, retaliation under workers’ compensation laws, and matters related to union and individual employee arbitrations.  His experience also includes addressing international employment issues.

 Mr. Smith is a member of the Texas Bar Association, Austin Bar Association Labor & Employment Law Section (Secretary 2003–2004; Treasurer 2004-2005; Vice Chair 2005-2006; Chair 2006-2007), and the American Bar Association.  He is licensed to practice in the Fifth Circuit Court of Appeals and the U.S. District Courts for the Northern, Western, Eastern, and Southern Districts of Texas, the Western District of Michigan, the District Court of New Mexico, and the U.S. Court of Appeals for the Armed Forces.

Susan Burton is a native Austinite. She is a Partner at the employment law boutique firm of Cornell Smith Mierl Brutocao Burton. She is Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization and serves as an Arbitrator in employment law cases for The American Arbitration Association.

Ms. Burton advises employers across many industries on personnel and employment law issues. She collaborates with employers on risk prevention strategies such as review and revisions of employee handbooks, employment agreements, and provides supervisor and employee training.

Ms. Burton also has extensive experience representing employers in litigation in state and federal court in employment law matters.

She has served on many non-profit boards throughout her career, in officer capacities and as a Board member, including Big Brothers Big Sisters of Central Texas, Volunteer Legal Services of Central Texas, and the Travis County Women Lawyer’s Foundation. She is currently on the Board of the YMCA of Austin and PAWS Shelter of Dripping Springs.

Susan is a fitness enthusiast and enjoys watching and playing sports. She has run seven marathons, including the Boston Marathon two times.
